Wanted former militant leader, Government ‘Tompolo’ Ekpemupolo, has prayed a Federal High Court in Lagos to transfer his case to the Court of Appeal to answer certain questions of law raised by the suit he filed against federal government.
Tompolo, through his lawyer, Ebun-Olu Adegboruwa, over the weekend told the court that the questions raised in the suit were very substantial and should be referred to the court of appeal for interpretation.
Tompolo was early this year, declared wanted by the federal government and a warrant for his arrest granted.
However, he has eluded security forces since, with many alleging that he has fled to Libya.
The ex-militant is seeking to stop the interpretation of certain parts of the Administrative Criminal Acts, 2015, which he says violate his constitutional right.
His suit before the court is contesting 221 and 306 of the Administration of Criminal Justice Act, describing it as invalid and unconstitutional.
The federal government has also prayed the court to dismiss Tompolo’s case, saying that it is an attempt by the former militant to avoid trial.
