Colonel Ojogbane Adegbe, the aide de camp (ADC) to former President Goodluck Jonathan has taken a legal action against the Economic and Financial Crimes Commission (EFCC) over his detention.

In the suit filed through his counsel, Ogwu Onoja, the former ADC is seeking N100 million damages for his detention, which he says “violates his fundamental rights”.

Onoja on Wednesday, urged the court to declare Adegbe’s arrest and continued detention by the EFCC since February 11, as unconstitutional.

He stated that the detention violated Adegbe’s right to personal liberty guaranteed by the 1999 Constitution.

He also petitioned the court to direct the EFCC to immediately release Adegbe from the unlawful detention.

The applicant’s counsel contended that the EFCC’s action violated Articles 5,6 and 12 of the African Charter on Human and Peoples’ Rights.

The case has been fixed for February 26 for hearing.
